Blue Guide on the implementation of EU product rules: update of version 2016

The Blue Guide is intended to contribute to a better understanding of EU product legislation and to its more uniform and coherent application across different sectors and throughout the single market. It is addressed to the Member States and to those who need to be informed of the provisions designed to ensure the free circulation of products as well as a high level of protection throughout the European Union. Its update has been launched at the beginning of 2020.
Roadmap for market surveillance: where are we?

The European Commission has recently renewed its strategy for the enforcement of single market rules. The plan published on 10 March 2020 aims to break down the barriers to a well-functioning single market. At a first glance it appears to be a wide-ranging and long-term plan with a significant package of initiatives. 22 actions have been grouped into 6 chapters. INCREASING KNOWLEDGE AND AWARENESS OF SINGLE MARKET RULES IMPROVING THE TRANSPOSITION, IMPLEMENTATION AND APPLICATION OF EU RULES MAKING THE BEST USE OF PREVENTIVE MECHANISMS DETECTING NON-COMPLIANCE INSIDE TH E SINGLE MARKET AND AT THE EXTERNAL BORDERS STRENGTHENING ENFORCEMENT ON THE GROUND IMPROVING HANDLING OF INFRINGEMENT CASES Particular emphasis is placed on the set up of a joint Single Market Enforcement Task-Force (SMET) that someone has defined “as a watchdog to police the enforcement and national compliance with EU law”. The SMET will be composed of Member States and Commission and will complement a cooperation network to be set up between national enforcement coordinators, making use of the existing Internal Market Advisory Committee (IMAC) framework. The plan will develop in line with the revision of several directives, acts and plans such as the General Product Safety Directive, the single market Transparency Directive, the Single Digital Gateway Regulation, the European Judicial Training Strategy and the adoption of new legislative proposals such as the new Services Notifications Directive. Chapter I “increasing knowledge and awareness of single market rules” foresees a revision of existing guidelines and handbooks, as for instance the Guide to the application of Treaty provisions governing the free movement of goods. Additionally, several new Guidance have been scheduled. Main arguments are: Legislative instruments in the digital area Principle of mutual recognition Product Liability Directive Article 4 - tasks of economic operators - of the Market Surveillance Regulation Chapter II “improving the transposition, implementation and application of EU rules” describes a strategy that will influence the process of transposition of the market directives. The process will be monitored through “dynamic virtual concordance tables” that will enable a continuous update on the state of transposition also after the entry into force of the original transposition laws. Chapter III “making the best use of preventive mechanisms” refers to the recently updated Proportionality Test Directive and the future implementation of the single market Transparency Directive as tools to prevent national measures contrary to EU law in the Member States. As for eliminating the barriers in the services single market, new legislative proposals such as the new Services Notifications Directive and a specific chapter in the preparatory work on the Digital Services Act has been foreseen. The actions in chapter IV “detecting noncompliance inside the single market and at the external borders” envisage the creation of a single European Information entry point for authorities to control non-food products bringing together existing systems such as ICMS and RAPEX. Moreover, the Internal Market Information system (IMI) will become the default tool for the administrative cooperation within the single market. The enforcement in the agri-food chain will strengthened and new labelling and traceability systems will be developed. Chapter V “strengthening enforcement on the ground” refers to a new EU Product Compliance Network composed by single liaison offices established in the Member States to represent their market surveillance authorities. SOLVIT, the online service that helps when EU rights as a citizen or as a business are breached by public authorities in another EU country, will be reinforced to become the default alternative dispute resolution tool in all single market policy areas. Finally, the actions of chapter VI “Improving handling of infringement cases” aim to give the highest priority to the cases having a significant impact on the single market; a single market Enforcement Strategic Report, identifying specific areas of concern and priorities for enforcement will be published annually. The EU pilot system, i.e. a tool for obtaining information in the phase of dialogue with the Member States at the pre-infringement stage, will be revised identifying clear and objective criteria for its use. Conclusion The plan seems very ambitious and one wonders whether it will be applied in full or in part, also considering the recent outbreak that is threatening the free movement of goods and people.

How to write instructions for use of products

As for the instructions for use as such general harmonised standards do not exist up to now. Commonly used standards for products instructions are: IEC 82079-1 Preparation of instructions for use ISO/IEC Guide 37:2012 – Instructions for use of products by consumers ISO/IEC Guide 37:2012 does not provide information covering each case. It offers guidance to the interested parties in the form of general principles and detailed recommendations on the design and the formulation of the instructions necessary or helpful to the user of consumer products.

CE marking: a guarantee of a safe machine

The manufacturer after having complied all the obligations of the Machinery Directive, mainly the assessment of the risks and eliminated or reduced them, he/she is responsible also to affix the CE marking on the machine.
What are the minimum requirements for the content of the instructions for use?

The list of minimum contents of the instructions for use given in Directive 2006/42/EC is not exhaustive. The manufacturer of the machinery should also provide other information that may be necessary. The Machinery Directive states in requirement 1.7.4.2 that " each instruction manual must contain, where applicable, at least the following information ...".
Inform users of the residual risks

The operating instructions are essential for the machine as they provide the user with the information necessary to operate the machine in safety conditions.

Safety: assessing harm and risk of harm

What is harm? Harm id defined as “injury or damage to the health of people, or damage to property or the environment”. What is risk? Risk is defined as the “combination of the probability of occurrence of harm and the severity of that harm”. This can be resumed as Risk = probability of occurrence of harm x severity of that harm What is safety? Safety is defined as “freedom from risk which is not tolerable”. This means that a tolerable risk is still present. This is an accepted risk in a certain the “context based on the current values of society”. Occurrence of Risk When a risk is considered present? Take a look to the picture here below. A snake alone is in the picture on the left. It is a hazard, but it alone is not enough to cause harm. A person is also in the picture on the right. This introduces the possibility of harm occurring the snake snatched the person. The picture on the right indicates a situation in which “risk” exists. What are risk assessment and risk reduction? The risk assessment is an overall process comprising a risk analysis and a risk evaluation. The risk analysis consists in a systematic use of available information to identify hazards and to estimate the risk. The risk evaluation procedure based on the risk analysis to determine whether tolerable risk has been exceeded. The risk reduction consists is action or means to eliminate hazards or reduce risks. “The iterative process of risk assessment and risk reduction for each hazard is essential in achieving tolerable risk”. The following procedure should be used to reduce risks to a tolerable level: a) identify the users for the product or system, including vulnerable consumers and others; b) identify the intended use of the product or system and assess the reasonably foreseeable misuse; c) identify each hazard (including reasonably foreseeable hazardous situations and events) arising in the stages and conditions for the use of the product or system, including installation, operation, maintenance, repair and destruction/disposal; d) estimate and evaluate the risk to the affected user group arising from the hazard(s) identified; e) if the risk is not tolerable, reduce the risk until it becomes tolerable.

ICSMS

Regulation (EC) 765/2008 setting out the requirements for the accreditation and the market surveillance related to the marketing of products is the European framework for the implementation of market surveillance. The regulation became applicable on 1 January 2010. In order to guarantee a uniform and coherent application of the EU harmonisation legislation, it sets out a framework of market surveillance in which minimum requirements are defined according to the objectives to be reached by the Member States and an administrative framework of cooperation which includes the exchange of information between the Member States. The Commission has already developed this system via an IT tool called ICSMS (Information and Communication System for the pan-European Market Surveillance). It consists of an internal area (accessible only to market surveillance authorities) and a public area. The market surveillance authorities upload their control activities to this application. ICSMS also serves as a tool for exchange and cooperation between these authorities. The most recent ICSMS version is available for all interested parties at the following address: webgate.ec.europa.eu/icsms A new initiative to update ICSMS to improve administrative cooperation, and to extend the system to cover non-harmonised goods (i.e. those that do not come under EU rules). RAPEX

Directive 2001/95/EC (19) on general product safety (GPSD) has set up the Rapid Alert System (RAPEX) which is used for dangerous non-food products between Member States and the Commission. Under certain conditions, RAPEX notifications can also be exchanged with non-EU countries. In the case of serious product risks to the health and safety of consumers in different Member States, the GPSD provides for the possibility for the Commission to take temporary Decisions on Union-wide measures, so-called ‘emergency measures’. Under certain conditions, the Commission may adopt a formal Decision requiring the Member States to restrict or prevent the marketing of a product posing a serious risk to the health and safety of consumers. RAPEX has been extended by Regulation (EC) No 765/2008 to apply to all harmonised industrial products irrespective of the final user (i.e. professional products) and to products posing risks to other protected interests than health and safety, for example risks to the environment. Functional Safety: reference standards

The first 3 standards listed here below are harmonised to the Machinery Directive and the last one to the ATEX Directive. EN ISO 13849-1:2008 Safety of machinery - Safety-related parts of control systems - Part 1: General principles for design (ISO 13849-1:2006) EN ISO 13849-1 provides instructions for system design, integration and validation. The standard can be used for the safety-related parts of control systems and various kinds of machinery, regardless of the technology or energy source used. It also includes special requirements for safety-related parts that have programmable electronic systems. This standard thus covers the entire safety function for all included devices (i.e. a complete safety chain such as sensor-logic-actuator). EN ISO 13849-1 defines how to determine the required Performance Level (PL) and how to verify the achieved PL within a system. PL describes how well a safety system is able to perform a safety function under foreseeable conditions. Five possible PLs are available: a, b, c, d and e. PL “e” has the highest safety reliability while PL “a” the lowest. The standard has replaced EN 954-1:1996 since 1 January 2012. EN ISO 13849-2:2012 Safety of machinery - Safety-related parts of control systems - Part 2: Validation (ISO 13849-2:2012) EN ISO 13849-2 specifies the procedures and conditions to be followed for the validation by analysis and testing of the specified safety functions, the category achieved, and the performance level achieved by the safety-related parts of a control system (SRP/CS) designed in accordance with EN ISO 13849-1. EN 62061:2005 Safety of machinery - Functional safety of safety-related electrical, electronic and programmable electronic control systems EN 62061 is the standard for designing electrical safety systems. It includes recommendations for the design, integration and validation of safety-related electrical, electronic and programmable electronic control systems for machinery. It describes the SRECS using the Safety Integrity Level (SIL) as EN 61508 but only until SIL3. The entire safety chain is covered. EN 61511-1, 2, 3:2004 Functional safety - Safety instrumented systems for the process industry sector EN 61511 series offers significant value to operators and integrators in the process industry. It sets out practices in the engineering of systems that ensure the safety of an industrial process using instrumentation. Such systems are referred to as Safety Instrumented Systems (SIS). A SIS is composed of any combination of sensor(s), logic solver(s) and final element(s). EN 50495:2010 Safety devices required for the safe functioning of equipment with respect to explosion risks EN 50495 defines with SIL the required safety level for monitoring of potential ignition sources of electrical explosion protected equipment and the requirements on the safety level of the respective safety devices. The standard offers a simplified evaluation procedure for hardware reliability for non-complex safety equipment as well.
Final adoption by the Council of the Regulation on Appliances Burning Gaseous Fuels

The purpose of the adopted regulation is to ensure that gas appliances and their fittings respect requirements for a high level of protection of the health and safety of persons, domestic animals and property and for sensible energy use as well. Typical appliances burning gaseous fuels include boilers, gas cookers, ovens, barbecues and patio heaters. Now gas appliances and fittings will be accompanied by the EU declaration of performance to show that they meet a single set of requirements. The regulation updates the provisions of Gas Appliances Directive 2009/142/EC.

Final adoption by the Council of the Regulation on Cableway installations repealing Directive 2000/9/EC

The Regulation on Cableway installations states provisions on the making available on the market and the free movement of subsystems and safety components for cableway installations. It contains rules on the design, construction and entry into service of new cableway installations designed to transport persons and applies to modifications of cableway installations requiring a new authorisation. Cableway installations are mainly lift systems, such as funicular railways, aerial ropeways (cable cars, gondolas, chairlifts) and drag lift.

New Regulation on Cableway installations in the legislative process

The European Commission adopted the proposal for a Regulation on Cableways in March 2014 that reflects the discussion with the MSs and the stakeholders and the outcomes of the impact assessment study. The proposal is under consideration by the European Parliament and the Council. If the adoption takes place in the second semester of 2015, in this case, the Regulation will be applicable in 2017, after a two-year transitional period, to allow manufacturers, notified bodies and Member States to adapt to the new requirements.
